On June 7, 2019, HB 409 “Electronic Legal Documents” was

signed into laws Chapter 2019-71 and took effect on January

1, 2020, in addition with 1N-7001, Florida Administrative Code.

This law authorizes Florida notaries to perform online remote

notarizations after the completion of an application and

training requirements.

According to the law any commissioned notary in Florida can

apply to become an online notary and to perform an online

notarization regardless of the physical location of the principal,

provided the notary is physically located in Florida while

performing the notarization.

Witnesses may be physically present with the principal or by

means of audio-video communication technology in conformity

with Florida law.

Remote Online Notaries must take certain steps to ensure the

security of the notarization, including the use of audio-video

technology to verify the identity of the principal.

Additionally, the entire audio-visual conference session must be

recorded and electronic journal shall be maintained for at least

10 years after the date of the notarial act.
